Fiscal Sponsorship Guidance

Example

ABC Non-profit applies on behalf of the XYZ Non-profit.

ABC is a 501(c)3 organization and has an active registration with the IRS. XYZ does not - XYZ may have a non-profit designation by the State of Oregon, rather than the IRS, or they may have applied to the IRS but not been approved yet - our Internet-based grant application system ONLY verifies tax status with the IRS database.

When ABC applies, using their active IRS tax id number, ABC is the actual applicant. ABC’s board and staff are responsible for managing grant funds and ensuring that grant deliverables are met.

This means that the board roster, financial statements, the organizational history and other documents are all from the ABC foundation.

If the application is successful representatives from both organizations should attend the check ceremony.

ABC organization makes sure the final report is delivered on time and is responsible for the accuracy of the statements and financials in the report.

Spirit Mountain Community Fund does not normally allow an organization to apply if they are acting solely as a fiscal sponsor for another organization. We do not fund grants where the organization receiving the money passes the money on to an organization that is not tax exempt.

On very rare occasions we will allow fiscal sponsorship arrangement, where a 501(c)3 organization applies for a non-tax exempt organization, but only if the project is structured as a partnership rather than a business transaction or simple flow through arrangement.

The organization that completes the application is the applicant agency and is responsible for all dealings with SMCF. Organizational information provided on the forms (including financials, board diversity and contact information) must be from the 501(c)3 applicant organization. This organization is responsible for managing the funds, ensuring the project is completed, and reporting in a timely manner. Details of the other organization and how the partnership will be managed should be outlined in the project description.

The 501(c)3 organization is legally responsible for the grant and is responsible for any agreements made with Spirit Mountain Community Fund.
